General Terms and Conditions
(GTCS)
1. Scope of Application
These general terms and conditions (GTC) apply to all business relationships between customers and Glacier Sport ski and hike GmbH.
2. Renting
Upon renting equipment in our shop locally or via one of our ski rental portals, Skirentalresorts or INTERSPORT Rent, a contract comes into force between the customer and Glacier Sport ski and hike GmbH. Personal information that you provide in the shop or on this website is processed and used in accordance with applicable national and European data protection legislation, in order to process the rental or your inquiries and online reservations. Glacier Sport ski and hike GmbH, Skirentalresorts, and INTERSPORT Rent will maintain the privacy of your data in all respects, and will not sell, rent, or otherwise make it available to third parties.
2.1 The customer confirms completion of the reservation/rental of the rental equipment, and the accuracy of the personal data that is used for adequate binding adjustment. It is prohibited to modify them arbitrarily.
2.2 The equipment can be picked up on the day before the first rental day from 16:00 onwards, and can be returned either at the end of the last rental day or the next day before 10:00. Each return after 10:00 entails an invoicing of an additional day in accordance with the respective rates.
2.3 Insurance: Damage from wear and tear caused by normal, appropriate use on the designated and open slopes/trails is included in the rental price. For a fee of 10% of the rental price, the customer can take out insurance for lost and stolen (with police report) rental items, and for ski breakage. This excludes damage caused by careless, improper, and grossly negligent usage! The rentee must independently pay for personal insurance such as liability or accident, etc.
2.4 Free exchange of skis in the same rental category. A category change is possible at any time subject to availability and with surcharge as per the price list. When changing to a lower category there will be no reduction in price.
2.4a The customer must generally pay for rental equipment in advance for the time period he or she has reserved.
2.4b Cancellation: Cancellation is possible exclusively due to illness, accident (with medical report), or other serious reasons (e.g. death of a close relative or travelling family member). The cancellation shall be made and justified in writing. There will be a cancellation charge for the cancellation of a reservation/payment in the amount of CHF 25 per person for whom something has been reserved. The difference between the amount already paid and the cancellation charge will be refunded to the rentee immediately. No rental price refund will be granted if the rented equipment is returned by the rentee late, or if it cannot be received for whatever reason. The same applies if the rentee returns the equipment to the renter early. Adverse weather conditions or other hindrances that are not in our power do not constitute grounds for cancellation. Customer injury or illness during the rental period is valid with the submission of a medical certificate in accordance with the following provisions: a) a refund of the rental price is only possible if the rented equipment is returned to the renter immediately after the onset of illness/injury. b) If point a) is fulfilled, the overpaid rental price will be reimbursed from the date of issue of the above-mentioned medical certificate. Without medical certificate no refund is possible. c) As soon as we have knowledge of the illness/injury and points a) and b) are satisfied, the overpaid rental price will be refunded.
2.5 All disputes arising out of, in connection with, or in relation to reservations or rental, or the use of equipment in the context of this reservation, are exclusively subject to the national courts of Switzerland.
2.6 The prices include 8% VAT.
3. Sales
Our online offer does not include the sale of goods. Sale takes place only in our stores in Zermatt.
3.1 Warranty, limitations of liability: Swiss law expressly applies. Your warranty claims are initially limited to free supplementary performance (repair or new delivery at the consumer’s choice). If the subsequent performance fails, you are entitled to a reduction of the purchase price or withdrawal from the purchase contract at your discretion.
3.2 Notification of defects: The buyer can make a complaint after purchasing the goods. Glacier Sport ski and hike GmbH undertakes to replace defective goods or to refund the purchase price to the purchaser. The purchaser must send the faulty goods to Glacier Sport ski and hike GmbH in unused condition.
4. Legal Disclaimers
4.1 Liability disclaimer: Glacier Sport ski and hike GmbH checks and updates the information on its website regularly. Despite careful controls of the content, we are not liable nor do we guarantee the accuracy or quality of the online information or for it being complete or up-to-date. The conditions for use apply for all content on the website www.zermattglaciersport.ch and for all subdomains belonging to this domain.
4.2 Glacier Sport ski and hike GmbH is not liable for the content of external websites that are referenced using hyperlinks. This also applies for all entries by third parties in guest books, discussion forums, bulletin boards and mailing lists set up by the website operator. Solely the operators of the linked websites are liable for the content of those sites. Linked sites are called up at one‘s own risk.
4.3 Data security: We generally use the personal data provided by you to respond to your request. The personal data will only be passed on or transmitted to third parties if this is necessary for the purpose of processing the rental, for billing purposes or if Glacier Sport ski and hike GmbH is legally obliged to pass on the data. However, the transmission of confidential information by e-mail is at the customer’s own risk. The customer has a right to information as well as the right to correct, block and delete his stored data.
